Welcome to Cachet. These Terms of Service (the “Terms”) are a legal agreement between you and Gomesin IT LLC, a New Mexico limited liability company (“Cachet,” “we,” “us,” or “our”), governing your access to and use of the Cachet website and services (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by Gomesin IT LLC. You can reach us at legal@cachet.gallery.
2. Eligibility
You must be at least 18 years old to use Cachet, and you must have the authority to enter into these Terms. The Service is not directed to anyone under 18, and we do not knowingly permit their use of it.
3. What Cachet is
Cachet is a private showcase and collector directory for cataloguing and displaying collections. It is not a marketplace, broker, escrow service, auction house, or an appraisal or authentication service. We do not buy, sell, or facilitate transactions in any item, and we do not verify the authenticity, ownership, condition, or value of any item shown on the Service. Any listing or figure on the Service reflects information provided by users, not a determination by Cachet.
4. Your account
You sign in with Google. You are responsible for the activity that happens under your account and for keeping your access secure. Tell us promptly at legal@cachet.gallery if you believe your account has been compromised.
5. Your content and the license you grant
You retain ownership of the photos, text, and other content you add to Cachet (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service — including displaying it on the parts of your profile you choose to make public, and in share cards and link previews generated from public content.
You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe anyone’s rights or violate any law.
6. Acceptable use
You agree not to:
- post content that is illegal, infringing, stolen, fraudulent, harassing, or abusive;
- impersonate any person or entity, or misrepresent your affiliation;
- upload material you do not have the rights to;
- attempt to break, probe, or circumvent the Service’s authentication or security;
- scrape, overload, or otherwise abuse the Service or interfere with others’ use of it.
7. The Verified membership
“Verified” is an optional paid membership (including the higher “Elite” tier) billed as an annual subscription through our payment processor, Stripe. It renews automatically each year until you cancel. You may cancel at any time through the billing portal; cancellation stops future renewals, and your membership remains active until the end of the period you already paid for. Partial periods are not refunded. Price changes apply on your next renewal.
The Verified check confirms the person as a curated collector who maintains a real presence on Cachet. It is not a statement about the authenticity, ownership, or value of any item in their collection.
8. Moderation and takedown
We may remove content or suspend or terminate accounts that violate these Terms or the law, or to protect the Service and its users. We respond to valid intellectual-property and takedown requests (including under the DMCA) — send DMCA and other takedown notices to our designated agent at abuse@cachet.gallery (see Section 16).
9. Our intellectual property
The Cachet name, brand, design, and software are owned by us or our licensors. These Terms grant you no right to use them except as necessary to use the Service as intended.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Any value, price, or estimate shown on the Service is entered by users and is not an appraisal, valuation, or guarantee of value by Cachet.
11. Limitation of liability
To the fullest extent permitted by law, Cachet and Gomesin IT LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim (or, if you paid nothing, USD $100).
12. Indemnification
You agree to indemnify and hold harmless Cachet and Gomesin IT LLC from claims, damages, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or end your access as described in Section 8. How your data is handled after termination is described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. The state and federal courts located in New Mexico will have exclusive jurisdiction over any dispute that is not otherwise resolved.
16. Reporting abuse and DMCA
If you believe content on Cachet violates these Terms, infringes your rights, or breaks the law, please report it. If you have an account, you can report a profile or item directly from its page while signed in. Otherwise, email abuse@cachet.gallery. We aim to review reports promptly and act on urgent matters — including anything illegal — within hours, and on other reports within a few days.
Our designated agent for notices under the Digital Millennium Copyright Act is Gomesin IT LLC, at abuse@cachet.gallery. A valid notice must identify the copyrighted work and the allegedly infringing material (including its location on the Service), include your contact information, a statement of your good-faith belief that the use is unauthorized, a statement made under penalty of perjury that the notice is accurate and that you are authorized to act on the rights holder’s behalf, and your signature. If we remove content in response to a notice, we will consider a valid counter-notification and may restore the content if the claim is not pursued further.
